Terms of Service

Plain English: You're getting a personal AI that handles your business and life through text messages and phone calls. You're responsible for how you use it, just like any employee or tool. We do our best to make it great, but AI isn't perfect. Use it legally and ethically, and we'll all be fine.

1. Agreement to Terms

By signing up for, accessing, or using Aunomy ("Service," "Platform," "we," "us," or "our"), you ("Customer," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms constitute a legally binding agreement between you and Aunomy (a California-based company). We may update these Terms at any time. Continued use after changes constitutes acceptance.

You are responsible for reviewing and approving all AI-generated communications before they are sent to third parties, including but not limited to: quotes, invoices, contracts, proposals, emails, and text messages. If you configure your Aunomy to send communications automatically, you accept full responsibility for those communications.

AI Disclosure on Calls: In compliance with applicable law (including California Business & Professions Code §17940 et seq.), your Aunomy will disclose that it is an AI system at the beginning of every phone call. You agree not to disable, circumvent, or instruct your Aunomy to hide this disclosure.

4. The Aunomy Network

4.1 How the Network Works

The Aunomy Network connects your AI with other Aunomy users' AIs to facilitate business matching, service discovery, and commercial transactions. When you or your customers make a request, your Aunomy may communicate with other Aunomys on the network to fulfill it.

By using the Service, you opt in to the Aunomy Network. This means:

Aunomy facilitates introductions and information exchange. Aunomy is not a party to any transaction between businesses on the network. All agreements, payments, and fulfillment are between the respective business owners. Aunomy does not guarantee the quality, legality, or completion of any network transaction.

4.4 Trust Scores

The network maintains trust scores based on completed transactions, ratings, response times, and reliability. Trust scores are calculated algorithmically and are not guaranteed to be accurate. Aunomy reserves the right to modify the trust scoring algorithm at any time.

5. Account & Security

5.1 Account Registration

You must provide accurate information during registration. Your account is tied to your phone number, which serves as your primary authentication method.

5.2 Account Security

You are responsible for maintaining the security of your registered phone number. Your Aunomy identifies you by this number. If your phone number is compromised, contact us immediately.

5.3 Sharing Your Aunomy's Number

You may share your Aunomy's phone number with friends, family, customers, and colleagues. People who text your Aunomy will receive service-level access only. Private information is protected and only accessible from your registered owner number.

When you connect third-party services to your Aunomy (Gmail, Google Calendar, Outlook, Stripe, etc.), you authorize Aunomy to access and use those services on your behalf within the scope you grant. Aunomy is not responsible for the availability, accuracy, or security of third-party services. Your use of those services is governed by their own terms.

8. Communications Compliance

8.1 TCPA Compliance

By signing up, you provide express written consent for Aunomy to send you automated text messages and make automated calls to your registered number. You may revoke consent at any time by texting STOP AUNOMY.

8.2 Your Customer Communications

You are responsible for obtaining proper consent before your Aunomy contacts any person. This includes compliance with:

Aunomy provides tools for consent management, but you bear ultimate responsibility for ensuring your use of the Service complies with all applicable communications laws.

8.3 E-Sign Act

By using SMS-based signup, you consent to electronic signatures and communications as permitted under the Electronic Signatures in Global and National Commerce Act (E-Sign Act, 15 U.S.C. § 7001 et seq.).

9. Billing & Payment

9.1 Usage-Based Pricing

Aunomy charges based on usage:

9.2 Payment

Payment is processed through Stripe. By subscribing, you authorize recurring charges to your payment method. You are responsible for keeping payment information current.

9.3 Refunds

We offer a 30-day money-back guarantee on your first month of usage. After that, all charges are non-refundable except in cases of documented billing errors.

10. Intellectual Property

10.1 Our IP

The Aunomy platform, brand, software, AI models, algorithms, network architecture, and all related intellectual property are owned by Aunomy. You are granted a limited, non-exclusive, non-transferable license to use the Service.

10.2 Your Data

You retain ownership of all data you provide to or generate through the Service, including business information, customer conversations, documents, and contacts. We claim no ownership of your data.

10.3 AI-Generated Content

Content generated by your Aunomy (emails, quotes, responses, etc.) is generated on your behalf and you may use it freely. However, Aunomy makes no warranty that AI-generated content is original, accurate, or non-infringing.

You agree to indemnify, defend, and hold harmless Aunomy and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

By you: Text STOP AUNOMY to your Aunomy's number at any time. Service stops immediately. You can restore service by texting RESTORE AUNOMY.

By us: We may suspend or terminate your account for violation of these Terms, non-payment, abuse of the network, or illegal activity. We will provide notice when practical.

After termination: Your data will be retained for 30 days and then permanently deleted, unless you request earlier deletion or legal requirements mandate longer retention.

15. Dispute Resolution

15.1 Informal Resolution

Before filing any formal dispute, you agree to contact us and attempt to resolve the dispute informally for at least 30 days.

15.2 Arbitration

Any dispute that cannot be resolved informally shall be resolved by binding arbitration under the rules of the American Arbitration Association (AAA). Arbitration shall take place in Los Angeles County, California. You waive any right to participate in a class action lawsuit or class-wide arbitration.

These Terms are governed by the laws of the State of California, without regard to conflict of law provisions.

16. Force Majeure

Aunomy is not liable for delays or failures in performance resulting from causes beyond our reasonable control, including natural disasters, war, terrorism, pandemics, government actions, power failures, internet or telecommunications failures, or third-party service outages.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy and any additional agreements you enter into with Aunomy, constitute the entire agreement between you and Aunomy regarding the Service.
